These Terms and Conditions set out the basis on which Rubbish Collection Maida Vale provides waste and rubbish removal services to residential and commercial customers. 1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

2. Scope of Services

The exact scope of work for each booking will be as agreed with you at the time of booking, based on the description of the waste, approximate volume or weight, access arrangements and any special requirements you have communicated. Any additional work requested on site which falls outside the original booking may be subject to additional charges and is at our discretion.

We reserve the right to refuse to collect any waste that we reasonably consider unsafe, unlawful to carry, improperly described, or not in accordance with relevant waste regulations, permits, or duty of care requirements.

3. Booking Process

You may request a booking by telephone, email or through any booking channel we make available. At the time of booking you will be asked to provide details including your name, contact information, collection address, type and approximate volume of waste, access details, preferred collection date and any relevant parking or loading information.

All bookings are subject to our acceptance and availability. Once we confirm the appointment date, time window and indicative price, a contract is formed between you and us for the supply of the services under these Terms and Conditions.

You are responsible for ensuring that all information provided during the booking process is accurate and complete. Incorrect descriptions of waste or access conditions may lead to changes in price, changes to the services we are able to provide, or the cancellation of the booking on arrival.

Where we provide an estimate based on your description or photographs, the final price may be adjusted on site after our team has inspected the waste and assessed the actual volume, weight and work required to safely complete the collection.

4. Access, Parking and Your Responsibilities

You must ensure that our team has safe and reasonable access to the rubbish to be collected at the agreed time. This includes arranging for keys, codes or security access where necessary and ensuring that any obstacles are removed as far as reasonably possible.

You are responsible for ensuring that appropriate parking or loading space is available for our vehicle as close as reasonably possible to the collection location. Any parking restrictions, permits or charges must be disclosed at the time of booking. You will be responsible for any parking charges, penalty charge notices or similar costs incurred as a direct result of inadequate information provided by you.

All waste presented for collection must belong to you or you must have the authority of the owner or occupier of the premises to dispose of it. You must not present any waste for collection which you do not have permission or legal right to dispose of.

5. Waste Types and Regulations

Our rubbish collection services are provided in accordance with applicable UK waste management regulations and duty of care requirements. We will transport and dispose of your waste only at licensed facilities or in accordance with lawful arrangements.

We collect general non-hazardous waste and bulky items such as furniture, bagged household rubbish, garden waste, construction offcuts and similar materials, subject to our capacity and safety assessment on the day.

The following items and categories of waste are generally not accepted: hazardous waste, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, paint in liquid form, oils, pressurised containers, gas bottles, explosives, radioactive materials, and any substances classified as hazardous under relevant legislation. We also may refuse to take contaminated waste, waste involving infestation, sharps, or any item that our team reasonably believes poses an unacceptable risk.

If hazardous or prohibited items are found mixed with the waste on arrival, we may either refuse the entire load or remove only the acceptable portion of the waste, with any additional sorting time charged at our prevailing rates. If such items are discovered after collection, you may be liable for any additional charges, fines, or costs associated with their safe handling and disposal.

6. Pricing and Payment

Our pricing is typically based on the volume and type of waste, as well as the labour and time required, access conditions and any disposal charges imposed by waste facilities. We may provide either a fixed price or an indicative price range at the time of booking, subject to final confirmation on site.

Unless otherwise agreed in writing, payment is due on completion of the collection. We accept common methods of payment such as debit or credit card, bank transfer, or cash, as notified to you at the time of booking or on site. Commercial clients may be offered account terms subject to credit approval, in which case payment is due within the agreed period from the date of invoice.

All prices are stated in pounds sterling and may be subject to VAT or other applicable taxes, which will be added at the prevailing rate where required by law.

If you fail to make payment when due, we reserve the right to charge interest on the outstanding sum at the statutory rate and to recover all reasonable costs of collection, including legal costs, in pursuing any overdue amounts.

7. Cancellations and Amendments

You may cancel or amend your booking by contacting us during our normal business hours. Where you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally apply. Cancellations made less than 24 hours before the scheduled collection time may be subject to a cancellation charge, which reflects the cost of allocated resources and lost opportunity.

If our team attends the property at the agreed time and is unable to carry out the service because you are not present (where your presence is required), access cannot be obtained, waste is not ready, or there is a breach of these Terms and Conditions, we may treat the booking as a same-day cancellation and apply a call-out or cancellation charge.

We will use reasonable efforts to accommodate any request you make to amend the date, time or details of your booking, but changes are subject to availability and may result in adjusted pricing if the scope of work changes.

We reserve the right to cancel or reschedule your booking due to events outside our reasonable control, including vehicle breakdown, severe weather, staff illness or safety concerns. In such cases we will notify you as soon as reasonably practicable and offer an alternative date or a refund of any prepayments.

8. Service Delivery and Timeframes

We will use reasonable skill and care in providing our rubbish collection services and will aim to attend within the agreed time window. However, any times given for arrival or completion are estimates only and are not guaranteed.

We are not liable for delays caused by traffic, road closures, accidents, adverse weather, or other circumstances beyond our control. If we expect a substantial delay, we will use reasonable efforts to inform you and agree a revised time or alternative arrangement.

Our responsibility for your waste begins when our team has loaded it onto our vehicle and ends when it has been transferred to a licensed facility or otherwise dealt with in accordance with applicable regulations. Up until the point of loading, responsibility for the waste remains with you.

9. Liability and Limitations

We will take reasonable care to avoid damage to your property while carrying out the collection. However, you acknowledge that some risk of minor scuffs or marks is inherent where heavy or bulky items are moved through confined spaces, stairwells or doorways. You should take reasonable steps to protect flooring, walls and fixtures where necessary.

Our liability for direct loss or damage to your property caused by our negligence is limited to the reasonable cost of repair or replacement, subject to a maximum aggregate liability per booking, which will not exceed the total price paid or payable for the services relating to that booking.

We are not liable for any indirect or consequential loss, loss of profits, loss of business, loss of opportunity or loss of goodwill arising from the provision or non-provision of our services, except where such liability cannot be excluded by law.

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which it would be unlawful to exclude or limit liability.

10. Customer Conduct and Health and Safety

You must treat our staff with respect and must not subject them to abusive, aggressive or unsafe behaviour. We reserve the right to withdraw our staff and cancel the booking if they reasonably believe they are at risk of harm, abuse or unsafe working conditions. In such circumstances, a cancellation charge may apply.

Health and safety is of primary importance. Our team may refuse to carry out any task that in their reasonable opinion presents an unacceptable risk to themselves, the public or your property. This may include collections requiring unsafe manual handling, access to structurally unsound areas, or work in the presence of hazardous materials.

11. Environmental Responsibility

We are committed to handling waste in an environmentally responsible manner. Where reasonably practicable, we will seek to reuse, recycle or recover materials collected through our rubbish removal services, in preference to disposal. However, no guarantee is given as to the proportion of waste that will be recycled or diverted from landfill in any particular booking.

By using our services, you authorise us to determine the most appropriate and lawful method of handling, sorting, transporting and disposing of your waste once it has been collected, subject to the requirements of applicable regulations.

12. Complaints

If you are dissatisfied with any aspect of our rubbish collection service, you should contact us as soon as possible with details of your complaint. We will investigate and aim to respond within a reasonable period. You agree to give us a fair opportunity to put matters right, which may include revisiting the property to complete or rectify the service where appropriate.

13. Data Protection and Privacy

We will collect and process personal information about you for the purposes of handling bookings, delivering services, managing payments and dealing with any queries or complaints. We will handle your personal data in accordance with applicable data protection laws in the United Kingdom and use it only for legitimate business purposes connected with the provision of our services or as required by law.

14. Changes to these Terms and Conditions

We may update or amend these Terms and Conditions from time to time to reflect changes in our business practices, legal requirements or service offering. The version in force at the time you make your booking will apply to that booking. Any updated version will be made available on request and will apply to future bookings only.

15. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the services or these Terms and Conditions, including any non-contractual disputes or claims.

16. General Provisions

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision will be removed or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall be construed as a waiver of that right or remedy. No waiver by us of any breach by you shall be considered a waiver of any subsequent breach.

You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another suitable provider, provided this does not reduce the level of service you receive.

These Terms and Conditions, together with the details confirmed at the time of booking, constitute the entire agreement between you and us relating to the provision of rubbish collection services and supersede all previous discussions, correspondence or understandings.
